1.1 CloudSort exists to help others develop their unique supply chain advantage. Collaboration is key and we are a community built on trust. A fundamental part of earning that trust means being clear about how we use your information and protecting your human right to privacy.
1.2 This Privacy Policy describes how CloudSort Corporation ("we," "us," "our," or "CloudSort") collects, uses, and shares personal information when you use our website cloudsort.com and the mobile application (collectively, the "Platform").
1.3 By using the Platform, you agree to the collection and use of information in accordance with this policy including any updates hereto.
2. Information We Collect
2.1 Information Needed to Use the CloudSort Platform.
We collect personal information about you when you use the CloudSort Platform. Without it, we may not be able to provide all services requested. This information includes:
2.1.1 Contact, Account, and Profile Information. Such as your first name, last name, phone number, business postal address, business email address, password, some of which will depend on the features you use.
2.1.2 Carrier (Supplier) Identity Information. Where appropriate, we may ask you for Commercial Driver’s License (CDL) details, US DOT/MC numbers, insurance policy documents, vehicle registration (VIN/Plate), and Social Security Number (SSN) or Employer Identification Number (EIN) for tax purposes (Form 1099).
2.1.3 Shipper (Buyer) Identity Information. Business address, pickup/drop-off contact details.
2.1.4 Payment Transaction Information. Bank account details (for payouts) or credit card information (for payments). Note: We utilize a third-party processor and do not store raw credit card numbers.
2.2 Information You Choose to Give Us.
You can choose to provide us with additional personal information, including:
2.2.1 Information About Others. Such as a payment instrument or contact information belonging to another person. By providing us with personal information about others, you certify that you have permission to provide that information to CloudSort for the purposes described in this Privacy Policy and you have shared the CloudSort Privacy Policy with them.
2.2.2 Communications Information. Such as email, message, SMS, and text information where delivery is enabled on or through the CloudSort Platform. Communication information may also include log information like your phone number, calling-party number, receiving-party number, account name, email address, time and date of communications, duration of communication, routing information, and the types and volumes of communications.
2.2.3 User-Generated Content. Such as any photos, videos, and other content you choose to provide.
2.2.4 Support Information. Such as call recordings and transcripts consistent with the requirements under applicable law, chat information, and messages collected to provide customer support services, including investigating and responding to user concerns and monitoring and improving our support processes.
2.2.5 Other Information. Such as when you fill in a form, add information to your account, respond to surveys, participate in research, post to community forums, import or manually enter address book contacts, provide your address and/or geolocation, provide business information, or share your experience with us.
2.3 Information Collected Automatically by Using the CloudSort Platform
When you use the CloudSort Platform, we automatically collect certain information. This information may include:
2.3.1 Geolocation Data. We collect precise real-time location data from Carriers’ mobile devices or ELD (Electronic Logging Device) integrations while a shipment is active to provide "Track & Trace" visibility to Shippers.
2.3.2 Device Information. Such as IP address, hardware and software information, device information, device event information, unique identifiers, crash data, and read receipts. We may collect this information even if you haven’t created a CloudSort account or logged in.
2.3.3 Usage Data Logs of how you interact with the Platform, booking history, and search queries. Such as searches for Listings, bookings you have made, additional services you have added, access dates and times, the pages you’ve viewed or engaged with, and other actions on the CloudSort Platform, including links you click to third-party applications. We may collect this information even if you haven’t created a CloudSort account or logged in.
2.4 Information We Collect from Third Parties
We may collect personal information from other sources, such as:
2.4.1 Background Checks We may receive data from third-party background check providers regarding criminal history or driving records.
2.4.2 Government Databases We verify your operating authority status via the FMCSA (Federal Motor Carrier Safety Administration) database.
3. HOW WE USE INFORMATION WE COLLECT.
We use your data for specific business purposes.
3.1 Provide the CloudSort Platform.
We may process this information to:
- enable you to access the CloudSort Platform,
- to match Shippers (Buyers) with Carriers (Suppliers) and facilitate the transportation of goods,
- to provide updates on cargo location to the Shipper (Buyer),
- to process escrow payments and issue tax documents (1099-K),
- to send transaction confirmations, delay notifications, and support messages.

3.2 Improve and Develop the CloudSort Platform.
We may process this information to:
- perform analytics, debug, and conduct research,
- improve and develop our products and services, and
- provide customer service training.
3.3 Safeguard the CloudSort Platform and Community
We may process this information to:
- verify or authenticate information provided by you, including identity information,
- detect, prevent, assess, and address fraud and security risks,
- conduct checks against databases and other information sources, including background checks,
- comply with our legal obligations,
- to detect "Double Brokering," or identity theft
- to verify that Carriers (Suppliers) hold valid licenses and insurance as required by the DOT/FMCSA,
4. SHARING AND DISCLOSURE
We do not sell your personal data. We share data only in the following scenarios:
4.1 Between Users (Shippers & Carriers) Once a booking is confirmed, we share the Carrier’s name, phone number, and location with the Shipper. We share the Shipper’s pickup/drop-off addresses and contact info with the Carrier.
4.2 Service Providers
Payment Processors: To facilitate money movement.
Background Check Services: To vet users.
Cloud Hosting: To store our data securely (e.g., Google Cloud Platform).
4.3 Legal and Regulatory We may disclose information if required by law, such as in response to a subpoena, court order, or request from the Department of Transportation (DOT) or law enforcement (e.g., in the event of suspected human trafficking or illegal cargo).
4.4 Insurance Purposes In the event of a cargo claim or accident, we may share relevant booking and user details with insurance adjusters and underwriters.
5. LOCATION INFORMATION (SPECIFIC TO TRANSPORTATION)
5.1 You acknowledge that a primary function of our Platform is to provide visibility into freight movement.
5.2 For Carriers: You consent to the collection of your location data from the time goods are “Tendered” to you until you mark "Delivered" or “Recovered”. You may disable location services in your device settings, but doing so may prevent accurate updates.
6. DATA RETENTION
6.1 We retain your personal information for as long as your account is active or as needed to provide you services.
6.2 Regulatory Retention: We are required by law to retain certain transaction records (Bills of Lading, Invoices, Payment Logs) for a minimum of 3 years for tax and audit purposes.
7. DATA SECURITY
While no organization can guarantee perfect security, we are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unlawful or unauthorized access, loss, destruction, or alteration. We implement industry-standard security measures (encryption, SSL, access controls) to protect your data.
8. YOUR RIGHTS
Depending on your jurisdiction (e.g., California, EU), you may have rights to:
- Access the specific data we hold about you.
- Request deletion of your data (subject to our legal obligation to keep records for the DOT/IRS).
- Opt-out of marketing communications.
9. CHILDREN’S PRIVACY
Our Platform is strictly for individuals aged 18 or older. We do not knowingly collect data from minors. If you are under 18, you are prohibited from using this Platform.
10. GEOGRAPHICAL LIMITATIONS
10.1 The CloudSort Platform is hosted and operated in the United States and is intended solely for use by individuals and entities within the United States.
10.2 Access to or use of the Platform from outside the United States is prohibited. By using the Platform, you acknowledge that your personal information will be processed and stored in the United States, which may have different data protection laws than your country of residence.
